Avoiding Suspensions & Points on Your License

The State of Georgia has several laws in place that can cause a person to lose their driving privileges.  According to the Department of Driver Services, a driver in Georgia can have their license suspended, revoked or even canceled for a number of reasons. The driver can reapply to get his or her license reinstated after the time period determined upon conviction of an offense is completed. (View Source)

In addition, a driver can have his or her license automatically suspended for a certain period of time for certain convictions. Those reasons include a conviction for homicide by vehicle, any felony in the commission of which a motor vehicle is used, using a motor vehicle in fleeing or attempting to elude an officer, fraudulent application for a license or fictitious use of a license, hit and run or leaving the scene of an accident, racing, operating a motor vehicle with a revoked, canceled, or suspended registration, felony forgery relating to an Identification document, refusal to take a chemical test in conjunction with an arrest for DUI, conviction for driving without insurance, conviction for driving while license is suspended, failure to appear in court or respond to a traffic citation, any violation of the Georgia Control Substance Act, a conviction for driving under the influence of alcohol, or drugs or accumulating 15 points within 24 months under the point system, including violations committed out of state.

A driver can, however, apply for a limited driving permit while his or her license is suspended. The driver can only drive to and from work, to get medical treatment or prescription drugs, attend class, attend support group or treatment meetings, or attend driver education classes while being issued a temporary driving permit. If the driver violates the permit, however, he or she could face an additional six-month suspension of their license.

If you received a speeding ticket or were cited for other moving violations, you could benefit from discussing your options with a traffic ticket defense attorney prior to taking any action. Drivers often fail to realize how quickly his or her driving record can be blemished by unexpected citations and how costly auto insurance surcharges and increases in annual premiums can be.

Although paying a traffic fine may appear to be the easiest way out, it may not be the smartest thing for you to do.  Many people do this without understanding the collateral consequences a speeding ticket, particularly anything greater than 14 mph, can have on your driving record and insurance rates.  I talked with a friend the other day who mentioned a relative of hers had two speeding tickets within a year and simply paid both as quickly as possible thinking it to be the best way to handle the infractions.  The friend further told me the relative’s insurance premium had doubled as a result of the tickets.  This is a disastrous scenario for anyone.  If ticketed for speeding or any other traffic offense, you must contact an experienced attorney who can help you avoid similar pitfalls.
